David Cross got us prettttty bad with that li'l Top Ten prank back in May. Because we're good sports over here at Pitchfork, we can admit when we get pwn'd... and we did, on our very own website no less. Hey, we can't all be professional comedians.
However, some people don't consider Cross's shenanigans a laughing matter. Thomas Weber, former manager of the Nashville, Tennessee venue Exit-In, filed a federal complaint on October 7 against Cross, Sub Pop Records, Time Warner, Warner Music Group, WEA, and Cross's production company, Liberal Jew Run Media Productions, for publishing his visual and vocal likeness without consent on Cross' 2002 CD Shut Up, You Fucking Baby! and 2003 DVD Let America Laugh.
Here's the lowdown: While Liberal Jew Run Media Productions (gee, that will sound great being announced in court) recorded Cross's performance at the Exit-In on May 18, 2002, Weber was allegedly taunted and taped without giving the a-okay. He would thus help Shut Up, You Fucking Baby! on its journey towards a Grammy nomination and a number 18 peak on Billboard's Heatseekers chart.
A press release from Weber states, "The federal complaint alleges that the Defendants reaped several million dollars in gross receipts and royalties from the sale of these products, which feature and showcase Mr. Weber without his authority or consent as the opening scene on the DVD. This case is important not only because of the unlawful use of Mr. Weber's actual likeness and voice for profit, but also to hold accountable an arrogant music industry which, itself, regularly sues individuals for downloading music and videos from the internet without paying for it and then claiming copyright infringement. The case seeks to establish that the entertainment industry cannot be allowed to conduct business in this manner and have it both ways."
Hmm, he does have a point there. Weber has even gone so far as to set up his own website, www.wearenotlaughing.com, laying out his case against Cross and co. The site's home page bears the tender message, "You're no Lenny Bruce! You're no Bill Hicks!" Ooh, that's gotta hurt.
Sub Pop, however, released the following statement to Pitchfork: "A former Nashville bar manager has alleged that the David Cross video showed him on film without his consent. The truth is that the club manager was fully aware that filming was taking place and he consented to it but years after the fact he's trying to distort the situation to his financial benefit. David's lawyers plan to vigorously defend this claim and we're confident that the truth will come out in court." In other words, shut up you fucking baby.
